Court Marriage In Surat.The marriage performed under the Special Marriage Act, 1954 is a civil contract and accordingly, there need be no rites or ceremonial requirements.Court Marriage means solemnizing a marriage according to the law. Couples may opt for a court marriage due to various reasons. One common reason in India is marrying against the wishes of family. Where either of the husband or wife or both are not Hindus, Buddhists, Jains or Sikhs, the marriage is solemnized and registered irrespective of the religion, under the Special Marriage Act, 1954.

Documents required for court marriage:-

1.Four Passport Size Photographs of both boy and girl.

2.Proof of Residence it can be a Voter Card / Passport / Ration Car / Driving License / Bank Passbook / Lease Deed / Rent Deed) of the concerned boy and girl.

3.A birth certificate or any document like Municipal Corporation Certificate, Xth or XIIth Examination Certificate, Passport, PAN Card of the concerned boy and girl.

3.If any party is divorcee – Certified copy of Decree of Divorce granted by the Court.

4.Death certificate or divorce decree whichever is applicable, in case one of the parties had any marriages in the past.
5.If any party is a Foreign Citizen or holding a foreign Passport or is having foreign residential address – Certificate of Present Marital Status of the party / No Impediment Certificate / NOC from concerned Embassy and Valid VISA.

6.Two Witnesses

Both the bride and the groom must fulfill the following conditions.

  • They should not have a living husband/wife at the time of marriage.
  • They should not be incapable of giving consent due to unsound mind.

  • They must not suffer from insanity or epilepsy.
  • The bride should be at least 18 years old and the groom at least 21.
  • Both parties must not be within prohibited relationship with each other.

What if marriage was solemnized but not registered?

Within 30 days of solemnizing a marriage it is mandatory to complete a registration procedure.In case of court marriage both the parties must submit a joint application with required documents at the nearby registrar office.A notice period or waiting period will be allotted to the parties during which if any objection is raised by anyone then the application will be on hold until the issue is resolved by the registrar officer and the parties.However, without any objection raised by anyone during this period, marriage certificate will be offered to the applicants after completion of the procedure.
